DMCA & Copyright Policy

1. Overview

FluxCode Studio LLC (“FluxCode”) respects intellectual property rights and complies with the Digital Millennium Copyright Act of 1998 (“DMCA”). If you believe content on fluxcode.studio or any service we operate infringes your copyright, you may submit a notice in accordance with the procedures below.

2. Designated DMCA Agent

3. Filing a DMCA Notice

To be effective under 17 U.S.C. §512(c)(3), your notification must include all of the following:

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate it (e.g., a URL).
  4. Contact information for the complaining party: address, telephone number, and email.
  5. A statement that the complaining party has a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner.

Notices that do not meet these requirements may not receive a response. Under §512(f), knowingly making material misrepresentations may subject you to liability for damages.

4. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification under 17 U.S.C. §512(g)(3), which must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location at which it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the original complainant.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If they do not file a court action within 10–14 business days, we may restore the material.

5. Repeat Infringers

In accordance with §512(i), we will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright.

6. Trademark Concerns

For non-copyright trademark complaints (e.g., logo misuse, brand impersonation), please email legal@fluxcode.studio with the trademark registration details and a description of the infringing use.

7. Other Reports

Reports of phishing, malware, harassment, or other abuse should be directed to abuse@fluxcode.studio.

8. Changes

We may update this policy from time to time. Material changes will be reflected by an updated “Last updated” date above. Continued use of our services following changes constitutes acceptance.
